[omniORB] COMM_FAILURE vs TRANSIENT in omniorb v3

Hi Neil,

  OmniORB3 is not compliant with the latest specs
in this case, but it is compliant with an older
spec, which allows for this. You should upgrade
to omniORB4, which does throw TRANSIENT in this
scenario.
